Acceptance of Terms

These Terms apply to all users of Baptizo, including readers/listeners and authors/creators.

User and Creator Accounts

To access certain features of our Services, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update this information as necessary.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately if you suspect unauthorized use of your account.

Intellectual Property Rights

All content on Baptizo, including text, graphics, logos, audio clips, and software, is owned by Baptizo or our content suppliers and is protected by international copyright and trademark laws.

Authors and creators retain ownership of any intellectual property rights associated with their content but grant Baptizo a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform the content in connection with providing the Services.

Creator Compensation and Revenue Sharing

For sales made through Baptizo, creators (authors) will receive 60% of the net revenue from each sale, while Baptizo retains 40%. Net revenue is defined as the total sales revenue minus any applicable fees, taxes, and other charges necessary to process the transaction.

Payments will be made to creators according to the payment schedule outlined on the platform, and creators are responsible for providing accurate payment details.

Content Submitted by Users and Creators

By submitting or publishing content on Baptizo, including but not limited to audio, text, and reviews, you grant us a worldwide, perpetual, royalty-free license to use, display, edit, modify, reproduce, distribute, store, and prepare derivative works of the content in connection with the Services.

You represent and warrant that you own or have the necessary rights to the content you upload and that such content does not infringe upon the rights of any third party.

Payment, Fees, and Purchases

Certain aspects of Baptizo may require payments or fees. By making a purchase, you agree to the pricing, fees, and payment terms detailed at the time of purchase.

You are responsible for providing valid payment information, and any failed transactions may result in suspension of access to certain services.

Refund Policy

All sales on Baptizo are final. We do not offer refunds unless explicitly stated otherwise or required by law. If you encounter any issues with your purchase, please contact us for assistance.

Termination

We reserve the right to suspend or terminate your account or access to the Services at our discretion, without notice, if you violate these Terms or engage in conduct that we believe may cause harm or liability to Baptizo, its users, or third parties.

You may terminate your account at any time, but you will remain responsible for any obligations or liabilities that accrued prior to termination.

Disclaimers

Baptizo is provided 'as is' without any warranties of any kind, whether express or implied. We do not warrant that the Services will be uninterrupted, error-free, or completely secure.

We do not guarantee any specific outcomes or levels of success from using our platform, including revenue generation for creators.

Limitation of Liability

In no event will Baptizo, its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims related to the Services will not exceed the greater of the amount you paid us in the past 12 months or $100.

Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.

Any disputes arising from or relating to these Terms will be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its rules. The arbitration will take place in New York, NY.

You agree to waive any right to a jury trial or to participate in a class action lawsuit.

Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through email or by posting a notice on the platform. Your continued use of the platform after any changes means you accept the revised Terms.
